Musk’s Incentives for Voters: Cash and a Million-Dollar Prize. Questions have arisen about the legality of cash incentives offered by Elon Musk to voters in swing states who sign his petition before the November 5 election. The petition, created by Musk’s campaign group America PAC to support Donald Trump, offers cash for signing and includes a million-dollar prize for one random signatory each day.
Legal experts warn that this could violate American law by offering money for voter registration. BBC News has reached out to his team and America PAC for comments.
Musk’s Incentives for Voters: Cash and a Million-Dollar Prize
The petition created by America PAC encourages voters in six swing states—Georgia, Nevada, Arizona, Michigan, Wisconsin, and North Carolina—to sign in support of free speech and the right to bear arms. Those who refer another voter are promised $47, while Pennsylvania offers $100 for signing or referring.
Each day until November 5, a $1 million prize will be randomly awarded to a signatory from one of the swing states, with the first prize given out at a town hall event in Pennsylvania on October 19.

Legal experts have raised concerns about the legality of Elon’s offer, suggesting it may violate US electoral law, which prohibits paying for voter registration or voting. Paul Schiff Berman highlighted that Musk’s offer is only available to registered voters, potentially running afoul of this law.
While some believe the strategy might exploit a loophole since signers are not being paid directly to register or vote, others argue that the context indicates it aims to induce voter registration, making it legally problematic. Adav Noti stated that Musk’s scheme violates federal law and could lead to enforcement actions, while constitutional law professor Jeremy Paul noted it is designed to circumvent legal restrictions, making it challenging to prove illegal in court.
What Other Actions Has He Taken?
Elon Musk, the world’s richest man, has shifted his political stance over the years, particularly expressing discontent with Democrats. He left the Democratic Party before the 2022 midterm elections and urged his followers to support Republican candidates. In 2023, he has become more active in American politics, making significant donations and promoting various Republican figures on social media.
He recently launched America PAC, aimed at supporting Donald Trump’s 2024 presidential campaign, contributing at least $75 million to the group. The PAC focuses on issues like secure borders, free speech, and a fair justice system. Although Trump stated he hadn’t kept up with Musk’s cash giveaways, he referred to Musk as a friend. Additionally, Musk has made appearances on the campaign trail, supporting Trump and engaging in town hall events.
